1. Who We Are and These Terms
Arkon Strategy is a division of Haxlab Digital Inc., registered in Vancouver, British Columbia, Canada. In these terms, “Arkon”, “we”, “us” and “our” refer to Haxlab Digital Inc. operating through its Arkon Strategy division. Contact details appear at the end of this document.
These terms govern your use of arkonstrategy.com, its enquiry forms, free website analyzer and reports supplied through the website. Using the website or submitting a request after being given notice of them constitutes your agreement to them. If you do not agree, do not use those services. You must have reached the age of majority where you live and have authority to act for any business on whose behalf you submit a request.
Our Privacy Policy explains how we handle personal information. Acceptance of these terms does not, by itself, give consent to marketing or to unrelated uses of personal information.
2. Website Information and Paid Services
Arkon’s services include Google Ads management, Google Maps and review support, search and AI visibility, landing page optimization, tracking and conversion optimization, and client reporting. The website describes our services; it is not an offer to deliver a particular scope, price or result.
Submitting a form, requesting an audit or discussing a project does not create a paid engagement or authorize charges. Paid work requires a separate agreement covering the scope, fees, advertising spend, approvals, payment, cancellation, ownership and any service commitments. That agreement controls the paid work if it conflicts with these website terms.
Access to a client dashboard, connected accounts, managed tracking or future subscription tools is subject to the applicable service or product agreement. Mentioning a planned feature does not promise its availability, release date or inclusion in any service. These terms do not establish a subscription, renewal, refund policy or software service level.
3. Free Website Audits
Only submit a website you own or are authorized to have assessed, and use accurate contact information for an inbox you control. You authorize us and our service providers to retrieve and analyze publicly accessible pages and relevant third-party datasets to prepare the requested report. This permission does not authorize access to private accounts, bypassing access controls or testing systems beyond the disclosed audit scope.
An audit is a limited snapshot of the pages, sources, locations and test conditions stated in the report. It may include website health checks, performance evidence, search and local visibility information, and AI-assisted review of collected content. Some checks or sources may be unavailable. A sample or demonstration report is illustrative and does not assess an arbitrary website entered into a preview.
An audit is not a comprehensive security assessment, accessibility certification, legal compliance review or guarantee that a website is free of errors. The public audit does not establish actual advertising performance, lead delivery, conversion attribution, sales or return on investment. Those questions require a separately authorized review of relevant accounts and business records. Browser interaction, purchase and checkout tests are included only if the report expressly says they were performed.
Estimates, rankings, AI-generated observations and recommendations can be incomplete or incorrect. Search engines and other platforms change independently of Arkon. Review findings in context, verify material conclusions and obtain appropriate specialist advice before acting. We do not guarantee a ranking, AI citation, traffic level, number of enquiries, sales result or financial return.
The audit is free and carries no obligation to buy services. We may limit requests, stop abusive use or pause the analyzer because of capacity, cost, security or provider availability. Public report links expire seven days after the request is accepted; this access period is stated before you request a report. Use Download PDF on the report to keep a copy if you need continued access. Expiry of an access link does not mean the underlying records have been deleted.
4. Your Information and Report Access
Provide only information you are entitled to share. Do not send passwords, payment-card details, government identifiers, health records or other sensitive personal information through the public forms, or submit private URLs containing credentials or access tokens.
You retain your rights in materials you supply. You grant Arkon only the permission needed to process those materials, work with service providers and respond to your request or deliver the agreed service. This does not give us permission to publish your confidential information, use your name or logo in a case study, or use your personal information for unrelated purposes.
A private report link or token may allow anyone who possesses it to access the report. Keep it confidential, share it only with people you authorize and contact us if you believe it has been exposed. You are responsible for choosing the correct recipient email address.
5. Permitted Use and Intellectual Property
Arkon or its licensors own the website’s original text, design, graphics, software and report format. Third-party names, data and materials remain subject to their owners’ rights. Except as permitted by law, you may not copy, republish, resell or commercially exploit the website or its software without permission.
You may view and use the website for lawful business purposes. You may keep your audit report and share it with colleagues and professional advisers for your business’s evaluation and improvement. Preserve source notices and limitations; do not alter findings in a way that misrepresents our work or present a report as a certification or endorsement. Rights in paid deliverables are governed by the relevant service agreement.
Do not:
- Submit another person’s information without authority, impersonate someone or send unlawful or infringing material.
- Bypass request limits, spam controls, authentication or restrictions on report access.
- Introduce malicious code, disrupt the website, probe for unauthorized access or retrieve another user’s reports.
- Use automated requests in a way that overloads the service or extracts reports or data without permission.
6. Third-Party Services
We rely on hosting, communications, website analysis, search data and other service providers. Their availability and data quality can affect the website and reports. Links to external websites do not constitute an endorsement. External websites and accounts have their own terms and privacy practices; review them before using those services.
Connecting a client’s advertising, analytics, website or other account requires that client’s authorization and an agreed service scope. A free audit request does not grant access to those accounts or authorize changes, advertising purchases or messages to the client’s customers.
7. Availability and Liability
We take reasonable care in providing the website, but do not promise uninterrupted availability or that all information is accurate, complete or suitable for a particular purpose. To the extent permitted by applicable law, the free website and audit services are provided as available, without implied warranties or conditions of merchantability, fitness for a particular purpose or non-infringement.
To the extent permitted by applicable law, Arkon is not liable for indirect or consequential losses, including lost profits, lost business opportunities or loss of anticipated savings arising from use of the free website or audit services. Paid-service liability is governed by the separate service agreement.
Nothing in these terms excludes liability for fraud, wilful misconduct or gross negligence, or limits any liability, consumer protection, privacy right or remedy that cannot lawfully be excluded or limited. You remain entitled to any mandatory protections that apply where you live. No contractual dollar cap on liability is established by these website terms.
8. Suspension and Changes
We may restrict or suspend access when reasonably necessary to protect the service, comply with law or address a breach of these terms. Where practical and lawful, we will explain the restriction. This does not remove your statutory rights or alter obligations under a paid-service agreement.
We may revise these terms and will identify the effective date of the revised version. Material changes will receive prominent notice and any further agreement required by law. Changes apply prospectively; they do not rewrite an existing paid agreement or retrospectively authorize a new use of personal information. You may stop using the website if you do not accept revised terms.
9. Governing Law and Disputes
These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Courts in British Columbia may hear disputes, subject to mandatory rights to bring proceedings elsewhere. These terms do not require private arbitration or waive class-action rights.
Please contact us first if you would like us to try to resolve a concern. Doing so is voluntary and does not restrict access to a court or regulator or extend any legal deadline. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision is not a waiver of it.
